Community Saving Fund (CSF) App - General Terms and Conditions

Please read these Terms and Conditions carefully before accessing or using the CSF website, mobile application, or any related services.

1. Introduction and Your Agreement

By accessing, subscribing to, or otherwise using the CSF app, website (https://communitysavingfund.com/), emails, or any other form of communication and service provided by CSF (collectively, the "CSF Service"), you ("you" refers to both the individual and the entity you represent) confirm that you have read, understood, and agree to be bound by these Terms and Conditions. These terms form a legally binding contract between you and Coltnet Enterprise Limited, Lusaka, Zambia ("CSF," "us," "we," or "our"), the provider of the CSF Service. If you do not agree to these Terms and Conditions, you must not access or use the CSF Service. Your continued use of the CSF Service constitutes your acceptance of these terms. Violation of these terms may result in the immediate cancellation of your account or denial of access to the CSF Service without prior notice.

2. Definitions and Key Terms

To ensure clarity and understanding within this Privacy Policy, every time any of these terms are referenced, they are strictly defined as follows:

  • Company, We, Our, Us: Refers to Coltnet Enterprise Limited, a company registered in Lusaka, Zambia, which is the provider and responsible party for the CSF platform and services.
  • Country: Refers to Zambia, where the principal offices of CSF are located.
  • Cookie: A small data file generated by a website and stored on your web browser. It is used to identify your browser, provide analytics, and remember user preferences.
  • CSF Service: Encompasses all services, features, content, and functionalities provided by CSF through its app, website, and other platforms, as described therein.
  • Device: Any internet-connected hardware, such as a phone, tablet, computer, or any other device, used to access and utilize the CSF Service.
  • Third-party Service: Refers to any advertisers, sponsors, partners, or other third parties that may offer content, products, or services relevant to or integrated with the CSF Service.
  • Website: Refers to CSF's official website, accessible at https://communitysavingfund.com/.
  • You: Refers to the individual or legal entity accessing or using the CSF Service.

    • 3. License Grant

    Subject to your compliance with these Terms and Conditions, CSF grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the CSF app and access the CSF Service strictly in accordance with these terms. This license is for your personal or internal business use only and does not permit you to reproduce, duplicate, copy, sell, resell, or exploit any portion of the CSF Service without express written permission from CSF.

    4. Restrictions on Use

    By using the CSF Service, you agree not to:

  • Unauthorized Access: Attempt to gain unauthorized access to any portion or feature of the CSF Service, or any other systems or networks connected to the CSF Service or to any CSF server.
  • Interference: Interfere with or disrupt the integrity or performance of the CSF Service or the data contained therein.
  • Harmful Conduct: Engage in any conduct that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Data Mining/Crawling: Use any robot, spider, scraper, or other automated means to access the CSF Service for any purpose without our express written permission.
  • Reverse Engineering: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the CSF app or website.
  • Malicious Software: Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Illegal Activities: Use the CSF Service for any illegal or unauthorized purpose, or in any way that violates any applicable local, national, or international law or regulation.
  • Resale: Sell, lease, rent, or otherwise transfer your access to the CSF Service to any third party.
  • Commercial Use: Use the CSF Service for any commercial purpose not expressly permitted by these Terms and Conditions.

    • 5. Limitation of Liability

    We may share your Personal Data in the following circumstances:

  • With Your Consent: We may disclose your Personal Data to third parties when we have your explicit consent to do so.
  • With Service Providers: We engage trusted third-party service providers to perform functions and provide services to us, such as hosting, data analysis, payment processing, customer service, marketing, and IT services. These providers have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • For Legal Reasons: We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend the rights or property of CSF, (c) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (d) protect against legal liability.
  • Business Transfers: In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your Personal Data may be transferred as part of that transaction. We will notify you before your Personal Data is transferred and becomes subject to a different Privacy Policy.
  • With Affiliates: We may share your information with our current or future affiliates for purposes consistent with this Privacy Policy.
  • With Third-party Services: We may share information with Third-party Services (such as advertisers, contest sponsors, promotional and marketing partners) for marketing, advertising, or other promotional purposes to offer you content, products, or services that may be of interest to you.
  • Aggregated or Anonymized Data: We may share aggregated or de-identified information that cannot reasonably be used to identify you. This information may be shared with partners or for research purposes.

    All intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the CSF Service (including its content, features, and functionality), are owned by Coltnet Enterprise Limited, its licensors, or other providers of such material. You are granted no right or license with respect to the CSF Service other than the limited license to use it in accordance with these Terms and Conditions. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the CSF Service.

    7. Third-Party Services and Links

    The CSF Service may contain links to third-party websites or services that are not owned or controlled by CSF. CSF has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that CSF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

    8. Pricing and Resource Usage Policies

    CSF reserves the right to revise pricing and resource usage policies for the CSF Service at any time, with or without prior notice. Any changes will be effective immediately upon posting on the CSF website or app. Your continued use of the CSF Service after any such changes constitutes your acceptance of the new pricing and policies.

    9. Termination

    We may terminate or suspend your account and deny access to the CSF Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms and Conditions. If you wish to terminate your account, you may simply discontinue using the CSF Service. All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

    10. Indemnification

    You agree to indemnify and hold CSF, Coltnet Enterprise Limited, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms and Conditions or your use of the CSF Service.

    11. Governing Law and Jurisdiction

    These Terms and Conditions shall be governed by and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or invalidity thereof, shall be exclusively settled by the courts located in Zambia.

    12. Severability

    If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms and Conditions will remain in full force and effect.

    13. Entire Agreement

    These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and CSF regarding your use of the CSF Service and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, concerning the subject matter hereof.

    14. Changes to These Terms and Conditions

    We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our CSF Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the CSF Service.
